Terms & Conditions

2. Booking and Course Fees

2.1 Courses are available in England, Scotland and Wales. We currently do not cover Northern Island.
2.2 Upon booking, we will send you a compulsory email requiring a direct reply. This email will be sent within 24 hours of receiving your deposit or full payment.
2.3 Course fees (“Fees”) are listed on our Website and include:
2.3.1 An Administration Fee for locating an Instructor, arranging your initial lesson, and booking the Practical Test and optional Theory Test.
2.3.2 A Tuition Fee for the Lessons.
2.3.3 The DVSA Practical Test fee.
2.3.4 The Theory Test fee is an optional extra.
2.4 Additional fees may apply (see sections 4.4 and 7.5).
2.5 We do not guarantee you will pass your Theory Test or Practical Test.
2.6 You are responsible for passing the Theory Test before the scheduled Practical Test. Failure to pass the Theory Test may result in the loss of the Practical Test booking and associated fees. Pass Expert will make reasonable efforts to assist in rescheduling the Practical Test, but cannot guarantee availability. Any additional fees incurred for rescheduling the Practical Test are your responsibility.

3. Payment

  • 3.1 An £150 non-refundable deposit (“Deposit”) is payable upon booking, unless you choose to pay the Fees in full.
  • 3.2 The Deposit is refundable if:
    • 3.2.1 We cannot find and book a Practical Test within your specified criteria or 10 working days of your booking (or receipt of Theory Test pass confirmation, if applicable), provided you have replied to our compulsory email.
    • 3.2.2 We cannot find an available Instructor within your specified criteria.
  • 3.3 The Theory Test fee is non-refundable.
  • 3.4 Unless Fees are paid in full at booking, the remaining balance is due:
    • 3.4.1 The day before your initial Lesson.
    • 3.4.2 When the Practical Test is booked.
  • 3.5 You must pay the Fees in full at least 24 hours before your initial Lesson.
  • 3.6 Additional Theory Test bookings require advance payment.
  • 3.7 All additional services, including but not limited to assessment lessons, require payment in advance. Pass Expert reserves the right to withhold services if payment is not received.
  • 3.8 We process payments on your behalf and, after deducting the Administration Fee, arrange payment of the Tuition Fee to the Instructor.
  • 3.9 You should not need to pay the Instructor directly.
  • 3.10 Refunds will be processed to the original payment card.
  • 3.11 We are a private limited company registered in England under company number 11915429.
  • 3.12 The Administration Fee may be non-refundable.
  • 3.13 The Tuition Fee may be non-refundable if an Instructor has been located.

4. Lessons

  • 4.1 You must present a valid UK provisional driving licence at your initial Lesson and to all subsequent Lessons and Tests.
  • 4.2 You have 120 days to start your Lessons after booking, unless otherwise agreed. Failure to start within this timeframe may result in forfeiture of the Deposit and Administration Fee.
  • 4.3 You are responsible for arranging Lesson times and pick-up locations with your Instructor.
  • 4.4 We are not responsible for Lesson punctuality.
  • 4.5 You may be charged for missed Lessons or if you are unavailable at the agreed time.
  • 4.6 The total Course time includes any breaks the Instructor deems necessary for safety or regulatory reasons.
  • 4.7 Lessons are non-transferable.
  • 4.8 You are expected to have reasonable availability for Lessons.
  • 4.9 The Course hours booked are an estimate. Pass Expert and the Instructor do not guarantee that you will be test-ready within the booked hours. Additional lessons may be required at an extra cost. The Instructor will assess your progress and advise on any additional lessons needed. Pass Expert is not liable for any perceived lack of test readiness.

5. Practical Driving Tests

  • 5.1 We will find a Practical Test within your specified criteria or 10 working days of your booking (or receipt of Theory Test pass confirmation, if applicable), provided you have replied to our compulsory email.
  • 5.2 Course hours include time for the Practical Test.
  • 5.3 We cannot guarantee a weekend Practical Test.
  • 5.4 A £20 surcharge applies to weekend Practical Tests.

6. Cancellation and Rearrangement

  • 6.1 You are responsible for understanding your Instructor’s cancellation and rearrangement policy.
  • 6.2 To change or cancel a Test, you must give us at least 4 full working days’ notice.
  • 6.3 Rearranging a Test incurs a non-refundable administration fee (£10 for Theory Test, £20 for Practical Test).
  • 6.4 Failure to provide 4 working days’ notice for cancellation will result in the full Test fee and an administration fee being charged.
  • 6.5 Courses cannot be downgraded.
  • 6.6 You can pause your Course; we will cease all work until you instruct us to resume.
  • 6.7 If we cannot contact you for 7 days or more, we may consider your Course paused.

7. Driving Instructors

  • 7.1 All Instructors are DVSA approved.
  • 7.2 Instructors may refuse a Lesson if you use abusive language, display threatening behaviour, fail to comply with reasonable requests, or appear under the influence of alcohol or drugs, or if, in your reasonable opinion, the Instructor’s conduct creates an unsuitable learning environment. You must report any such concerns to Pass Expert immediately.
  • 7.3 Instructors may refuse use of their car for the Practical Test if they deem your driving unsafe.
  • 7.4 Instructor changes are at Pass Expert’s discretion. If a change is granted, an assessment lesson with the new Instructor may be required at an additional cost.
  • 7.5 You may need to show your Instructor the DVSA Practical Test confirmation email.
  • 7.6 We cannot guarantee Instructor preferences (gender, car make/model/fuel type) unless agreed.

8. Limitation of Liability

  • 8.1 Neither we nor the Instructor are liable for loss or damage where:
    • 8.1.1 There is no breach of legal duty.
    • 8.1.2 The loss or damage is not a foreseeable result of a breach.
    • 8.1.3 The loss or damage results from your breach, action, or omission.
    • 8.1.4 The loss or damage results from circumstances outside our, the Instructor’s, or your reasonable control.
  • 8.2 We do not exclude or limit liability where unlawful to do so.
  • 8.3 We are not liable for any business-related losses.
  • 8.4 As an agent, we are not party to the tuition contract but may be liable for loss or damage caused directly by our breach of legal duty.
  • 8.5 Missed Lessons or Tests due to instructor illness, vehicle breakdown, or other circumstances outside our or the Instructor’s control will be assessed on a case-by-case basis.
  • 8.6 We are not responsible for DVSA Test changes or cancellations. Rearranging a rescheduled Test may incur an administration fee for fast-tracking.
  • 8.7 You must inform us of any issues in a timely manner. Issues raised after the Course completion may not be considered.
  • 8.8 Pass Expert will primarily communicate with the customer who booked the Course. We are not obligated to engage in communication with third parties regarding the Course or any complaints.

9. Use of Personal Data

  • 9.1 We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018 to:
    • 9.1.1 Arrange Instructor contact and Test bookings.
    • 9.1.2 Process payments.
    • 9.1.3 Communicate with you and inform you of our products and services.
  • 9.2 We will only share your data with third parties where lawful.
  • 9.3 When booking your Test, we may access the DVSA website using your details and change the contact email address to ours to manage bookings and receive notifications.

10. Behaviour

10.1 We have a zero-tolerance policy towards abuse, harassment, or violence (physical or verbal) towards our staff or Instructors. We reserve the right to cancel bookings in such events, with potential forfeiture of Fees.

11. Law

11.1 These Terms are governed by English law.

12. Cancellation Period

  • 12.1 You have 14 days to cancel your booking after the day of booking. We will not start work until this period expires, unless you waive this right.
  • 12.2 Replying to our initial email before the 14-day period expires waives your cancellation right.
  • 12.3 Repeat customers are assumed to waive their cancellation right unless stated otherwise.
